Understanding Our Cancellation Policy
We understand that business needs can change. This cancellation policy is designed to be fair to both parties while protecting the investment of time and resources made by our team. Please read this policy carefully before engaging our services.
How to Cancel a Project
All cancellation requests must be submitted in writing. Follow these steps:
Acknowledge Receipt
We will confirm receipt within 24 hours and provide a project status assessment
Important: Verbal cancellation requests are not valid. Please ensure you receive written confirmation from us acknowledging your cancellation.
Project Cancellation Terms
Cancellation Before Work Commences
If you cancel your project before we have started any work:
- You receive a full refund of your deposit
- A 5% processing fee is deducted to cover payment gateway charges
- Refund processed within 7-10 business days
Cancellation During Discovery/Planning Phase (0-25%)
If you cancel during the initial planning and discovery phase:
- Work completed up to cancellation date will be invoiced
- 75% refund of remaining project balance
- All deliverables completed will be handed over
Cancellation During Development Phase (25-50%)
If you cancel when project is between 25-50% complete:
- All work completed will be invoiced at agreed rates
- 50% refund of remaining project balance
- Source code and assets for completed work will be provided
Cancellation During Late Development (50-75%)
If you cancel when project is between 50-75% complete:
- Full payment required for all completed milestones
- 25% refund of remaining project balance
- All completed deliverables will be handed over
Cancellation After 75% Completion or Delivery
If you cancel after 75% of the project is complete or after final delivery:
- Full payment of the entire project value is required
- No refund is available at this stage
- All project deliverables and assets will be provided
Service-Specific Cancellation Terms
Consultation & Meeting Cancellations
- 48+ hours notice: Full refund or free rescheduling
- 24-48 hours notice: 50% fee charged, remainder refunded
- Less than 24 hours: Full consultation fee charged (no refund)
Retainer & Subscription Services
- Provide 15 days written notice before the next billing cycle
- Current billing period is non-refundable
- Services continue until the end of the paid period
Digital Marketing Campaigns
- Minimum 30 days notice required for campaign cancellation
- Ad spend committed to platforms is non-refundable
- Management fees prorated for remaining period
Maintenance & Support Contracts
- Provide 30 days written notice for contract termination
- Unused prepaid hours do not carry over or get refunded
- Transition support provided during notice period
Termination by Emizhi Digital
We reserve the right to terminate a project under the following circumstances:
- Non-payment or late payment beyond 30 days of invoice date
- Breach of project agreement or Terms & Conditions
- Client unresponsiveness for more than 30 consecutive days
- Requests for illegal, unethical, or harmful content
- Abusive or threatening behavior towards our team
Our Obligations Upon Termination
If we terminate the project, we will provide you with all completed work up to the termination date and a detailed accounting of work performed. Any refund due will be processed as per our Refund Policy.
Governing Law & Jurisdiction
This agreement is governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts in Kerala.
After Cancellation
You Will Receive
- All source code and assets for completed work
- Documentation for completed features
- Final invoice detailing all work performed
- Access credentials for any accounts created
Please Note
- Support ends upon project cancellation
- Future work requires a new agreement
- We may showcase completed work in our portfolio
- Confidentiality obligations remain in effect
